Welcome to GetChune! These Terms and Conditions ("Terms") govern your use of the GetChune service ("Service") provided by BOK Solutions ("we," "us," or "our"). You agree to be bound by these Terms by accessing or using the Service. If you do not agree with these Terms, please do not use the Service.

1. Service Overview

GetChune allows users ("you" or "User") to send music requests to DJs, MCs, or Entertainers for radio or live sets. The Service facilitates communication between music lovers and DJs but does not play the songs on the platform itself. Instead, we ensure that the songs will be played by the DJ/MC/Entertainer to whom the request was made. We try to ensure the DJ plays the song within a period between 30-60 minutes after the request was made.

2. DJ Acceptance and Refund Policy

• DJs have the discretion to accept or reject a request to play a song.

• If the DJ accepts the request but the song is not played within the specified time frame, we will contact the requestor to begin the refund process.

• Refunds may take up to 3 business days to reflect and will be for 80-100% of the total cost, depending on the circumstances.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

4. Account Registration

To use certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Responsibilities

• You agree to use the Service only for lawful purposes.

• You agree not to submit content that is offensive, defamatory, or infringes on the rights of others.

• You agree not to interfere with the functioning of the Service or attempt to access areas of the Service that you are not authorized to access.

6. Content Ownership and Use

• All content submitted by Users remains the property of the User. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute the content in connection with the Service.

• We reserve the right to remove or modify any content that violates these Terms or is deemed inappropriate.

7. Intellectual Property

All intellectual property rights in the Service, including but not limited to text, graphics, logos, and software, are owned by us or our licensors. You may not use, reproduce, or distribute any content from the Service without our express written permission.

8. Payment and Fees

Certain features of the Service may require payment. All fees are non-refundable unless otherwise specified, except as stated in our refund policy. We reserve the right to change the pricing and fees for the Service at any time.

9. Rights to Music

We do not own the rights to any of the songs requested through the Service. The Service does not play the songs on the platform; we only facilitate DJs and MCs to see the songs requested by their requestors.

10. Termination

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Disclaimers

• The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied.

• We do not guarantee that the Service will be uninterrupted or error-free.

• We are not responsible for any content submitted by Users or for any actions taken by DJs in response to music requests.

12. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

13. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, and expenses (including attorney's fees) arising out of your use of the Service or your violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Service after any changes have been made will constitute your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law principles.
